高校学生人身安全事故频出引发社会广泛关注。因目前针对此类问题进行责任认定和处理的法律规章缺位,社会对于高校责任和管理正确合理认识的缺乏,家校及时有效沟通工作的缺失等诸因素综合作用,高校在应对和处理中面临重重困境。文章结合《学生伤害事故处理办法》《高等教育法》等相关规定,对高校学生人身伤害事故进行概念分析,并厘清其与大学生非正常死亡事件的关系,以期为后续研究的顺利展开奠定基础。
Frequent accidents with college students lead to widespread social concern. Due to the current lack of legal rules and regulations on the identification and treatment of such problems, the lack of social awareness of the correct and reasonable responsibilities and management of colleges and universities, and the lack of timely and effective communication between schools and schools, the overall role of colleges and universities in response and handling Heavy dilemma. In this paper, the concept of “dealing with student injury accidents” and the “law on higher education” are introduced to analyze the relationship between college students’ personal injury accidents and clarify their relationship with the unnatural deaths of college students so as to lay the foundation for the successful development of the follow-up study.
