胡汉民是革命派重要的理论家和宣传家,在辛亥时期对于条约执行问题进行过深入的思考,但现有成果主要聚焦于胡汉民主张革命派承认和执行旧约问题。实际上,胡汉民还系统阐发了条约执行的一般理论与实践,在此基础上,又对清政府专制统治下中国执行条约的现状与问题进行了剖析,进而辩明应以排满革命为解决问题之根本手段。这些言论具有相当的国际法水准和认知水平,既强化了革命的正当性与必要性,也展示出革命性与妥协性并存的复杂情状。
Hu Hanmin, an important theoretician and propagandist of the Revolutionary Revolution, made deep pondering over the implementation of the treaty during the Xin Hai period. However, the existing achievements mainly focus on Hu Hanmin’s claim that the revolutionary parties recognize and implement the Old Testament issue. In fact, Hu Hanmin also systematically expounded the general theory and practice of treaty implementation. On this basis, he also analyzed the status quo and problems of China’s implementation of the treaty under the authoritarian rule of the Qing government, and further argued that it should solve the problem The fundamental means. These remarks have considerable standards of international law and cognition. They not only strengthen the legitimacy and necessity of the revolution, but also show the complicated situation of both revolutionary and compromise.
