死刑缓期制度是中国刑事立法所独创的一项制度,具有鲜明的中国特色,对我国死刑的执行起着至关重要的制约作用。由于我国现阶段所处的状况和现实条件,使得我国暂且不可以废除死刑立即执行制度。这也是目前我国加大死刑缓期执行制度运用的原因之一。但在实际操作中死刑缓期执行制度本身存在的缺陷和相应产生的现实问题不容小觑。这就需要我们加大完善立法,并将死刑缓期执行作为判处死刑的必经程序。
The system of death penalty suspension is a system created by the Chinese criminal legislation with distinctive Chinese characteristics and plays a crucial role in the execution of the death penalty in our country. Due to the current situation and the actual conditions in our country at the present stage, our country can not abolish the system of executing the death penalty for the time being. This is one of the reasons for increasing the implementation of the system of postponing the execution of death penalty in our country. However, in actual operation, the defects in the system of execution of suspended execution and the corresponding realistic problems should not be underestimated. This requires us to increase and improve the legislation, and the implementation of the suspension of death penalty as a mandatory procedure for the death penalty.
