本文以罗彩霞案为例,分析了网络民意的价值,解读了司法实践中网络民意与法意的冲突,研究了实现法意所面临的困境及原因,探讨了如何在新媒体介入,倡导民生的大环境下处理好网络民意与法意的关系,更好地促进司法机关在两难困境时作出公平正义,能满足公民司法诉求的裁决的方法和途径。
This article takes Luo Caixia case as an example, analyzes the value of network public opinion, interprets the conflict between internet public opinion and french meaning in judicial practice, studies the difficulties and reasons for the realization of french meaning, discusses how to intervene in new media and promote people’s livelihood , We should better handle the relationship between Internet public opinion and French law and better promote the ways and means by which the judiciary can make fairness and justice in dilemma and can satisfy the ruling of citizen’s justice.
