作为法律关系内容的权利与义务,仅指法律权利和法律义务。在社会生活中,权利和义务多被当作法学范畴来看待,但实际上,权利与义务还存在于法学范畴之外的领域。从文化遗产的保护与开发角度来看,其中权利指的是人对文化遗产的需求,义务指的是人要对文化遗产负责。文化遗产保护中权利与义务的关系,相当于文化遗产保护与开发的关系,“非遗”权利与义务关系亦然。文化遗产的保护与开发是相辅相成的关系,不论“非遗”旅游开发的直接参与者还是间接参与者,都要在享有权利的同时认真履行相应的义务。
The rights and obligations as the content of legal relations refer only to legal rights and legal obligations. In the social life, the rights and obligations are mostly regarded as the category of jurisprudence, but in fact, the rights and obligations exist in areas beyond the realm of jurisprudence. From the perspective of the protection and development of cultural heritage, the right refers to the demand of people for cultural heritage, and the obligation means that people are responsible for the cultural heritage. The relationship between rights and obligations in the protection of cultural heritage is equivalent to the relationship between the protection and development of cultural heritage and the relationship between rights and obligations of non-heritage. The protection and development of cultural heritage are mutually reinforcing relations. Regardless of whether they are direct participants or indirect participants in the development of non-heritage tourism, their obligations must be met earnestly while enjoying their rights.
