刑事立案监督权的配置应当坚持和体现三项原则,即控制权力、救济权利以及与诉讼监督权的内在规律相契合。建议检察机关设置专门的刑事立案监督部门,保证刑事立案监督权的统一实施。
The allocation of the power to supervise criminal cases should adhere to and embody the three principles that control power, remedy rights and conform to the inherent law of litigation supervisory power. It is suggested that the procuratorial organs should set up special departments for supervising criminal cases to ensure the uniform implementation of the right of supervision over criminal cases.
