建设工程是在现实生活中普遍存在并且广泛应用的一种合同大类。目前学界没有太大争议的一点是,建设工程合同具有传统民法上一般的加工承揽合同相似的特征,但由于建设工程合同的客体为不动产,基于不动产的特殊性质又不能与一般的加工承揽合同相提并论。那么,建设工程合同的性质如何认定,是否能适用加工承揽合同的一般规定,甚至加工承揽合同中承揽人的特殊权利是否能移植到建设工程合同中承包主体上,是理论界和实务界需要解决的问题。
