话语分析有助于阐释执法活动中呈现的多重意义解释,通过话语分析可丰富对城管执法困境的认识。严格执法、服务大局的执法话语存在诸多不足,遭受来自其他话语的质疑,难以有效实现对城管执法活动正当性的论证。媒体舆论对权利话语和“弱者的武器”话语的片面采用存在较大偏差,城管执法状况被选择性呈现,执法问题泛政治解读,易导向对体制的否定,引发社会对立情绪。社会主义话语的使用方式具有多样化,既会导向舒缓执法冲突,也会导致加剧执法者和执法对象之间的紧张关系。改善城管困境,需要塑造话语,推动公共规则的形成,达成兼顾不同社会群体利益的执法效果,推动法治建设的务实开展。
Discourse analysis helps to explain the interpretation of multiple meanings in law enforcement activities. It can enrich the understanding of the dilemma of urban administration enforcement through discourse analysis. Strict law enforcement, service law enforcement discourse there are many deficiencies, subject to questions from other discourses, it is difficult to effectively achieve the legitimacy of urban management law enforcement argument. There is a big deviation in the one-sided adoption of rights discourse and “weak arms” discourse by the media, and the law enforcement of urban management is selectively presented. The political interpretation of law enforcement issues is easy to guide the negation of the system and the social antagonism. The diversification of the use of socialist discourse not only leads to a soothing of law enforcement conflicts but also aggravates the tension between enforcers and law enforcement officials. To improve the predicament of urban management, we need to create discourse, promote the formation of public rules, and achieve the effect of law enforcement taking into account the interests of different social groups so as to promote the pragmatic development of the rule of law.
