在集体土地征收过程中,较多领域和环节涉及村民自治权的适用。当前,不管是征地调查申报阶段、征地公告阶段,还是征地补偿款的给付和管理阶段,均涉及村民自治权利的行使。然而,由于相关法律规定模糊、集体土地征收工作人员观念与意识滞后、村民自身权利意识和自治观念缺乏等原因,导致县、乡政府及其工作部门、村民委员会在集体土地征收过程中,侵犯村民自治权利的现象大量存在。应以构建法律体系和充实法律内容为基础,加强集体土地征收过程监督和完善村民自治制度为关键,多维举措,切实保障集体土地征收过程中村民自治权的实现。
