尽管欧盟一体化的进程在不断推进,但欧盟司法区域的建立却相当困难。欧盟反欺诈办公室及欧洲司法合作组织都曾从不同角度通过不同经历对建构欧盟司法区域发挥了重要作用,但由于二者缺乏完整的行动权及强制性权力,尤其是司法侦查权,欧盟层面的刑事执法仍然非常薄弱。要加强欧盟层面的刑事执法,应当采取一系列措施,尤其是使欧洲司法合作组织成为侦查机关、授予欧盟反欺诈办公室司法侦查权和设立欧洲检察院。
Although the process of EU integration is advancing steadily, the establishment of EU jurisdictions is rather difficult. Both the EU Anti-Fraud Office and the European Organization for Judicial Cooperation have played an important role in building EU jurisdictions through different experiences from different perspectives. However, due to the lack of complete actions and mandatory powers, especially the judicial investigation power, EU-level Criminal law enforcement remains very weak. To strengthen the criminal law enforcement at the EU level, a series of measures should be taken, especially making the European Judicial Cooperation Organization an investigative organ, granting the EU anti-fraud office the judicial investigative power and establishing the European Procuratorate.
