新修订的《律师法》于2008年6月1日起施行。新律师法扩大和完善了律师的会见权、阅卷权、调查取证权和法庭言论豁免权等权利,有效地解决了刑事诉讼中律师执业中存在的会见难、阅卷难、取证难等难题,使控辩双方趋于平等,控辩式庭审方式日趋巩固。在日趋激烈的控辩平等对抗的条件下,检警双方需要进行关系重构,在分工制约的同时加强配合,构建检察指导侦查的检警关系模式。
The newly revised Law on Solicitors will come into effect on June 1, 2008. The law of new law expands and perfects lawyers’ rights of meeting, reading, investigating and collecting evidence, and immunity of speech of the court, and effectively solves the difficult problems such as difficulty of meeting, difficulty of reading and evidence gathering in the practice of lawyers in criminal proceedings. Both prosecution and defense tend to be equal, and the prosecution and defense trial methods have become increasingly consolidated. Under the condition of increasingly fierce antagonism between prosecution and defense, both sides need to reconstruct their relations, and at the same time, they should strengthen their coordination with the restriction of labor division to establish a pattern of prosecutorial and police officers and police investigators for investigation.
