闫德利案件曾得到新闻媒体的广泛关注,社会影响极大,我们在给予受害人同情的同时,不免忧虑闫德利的受损名誉将得到法律的何种救济。从我国现行法律规定来看,对犯罪行为人的刑事处罚远远不能弥补受害人的精神痛苦,解决之道惟有完善现行法律,将精神损害赔偿引入附带民事诉讼中。
Yan Deli’s case has received wide media attention and great social impact. While giving sympathy to the victims, we can not help but worry about what kind of relief the lawyer will receive under Yan Deli’s damaged reputation. Judging from the current laws and regulations of our country, criminal penalties for criminals are far from compensating for the suffering of the victims. Only by improving existing laws, compensation for mental damages can be introduced into incidental civil actions.
