20世纪60年代以来,伴随着新古典经济学、制度经济学和福利经济学等新经济学逐渐渗透到法律学领域,刑法也不可避免地成为了经济分析法学的领地。本文从经济学的角度对刑法进行分析,通过对刑法的另类解读,找寻改善刑法的途径,提高刑法的威慑效应,促进刑事司法资源的优化配置,从而更加有效地预防和惩治犯罪,维护社会的安定。
Since the 1960s, along with the neo-classical economics, institutional economics and welfare economics and other new economics gradually penetrate into the field of law, criminal law will inevitably become the territory of economic analysis jurisprudence.
