近年来,随着我国经济建设的不断加速以及社会建设步入转型期等因素影响,各个领域各个层面的职务犯罪也渐呈高发态势,肩负着反腐倡廉职责的检察机关也有了越来越重大的社会作用。但在积极进行职务犯罪预防和查办的同时,因否对职务犯罪分子进行民事追偿却是一个在实践中存在争议的问题。本文中,笔者拟从一起案件入手,对上述问题进行一定的思考与分析,望能对该问题的探讨作出自己的一份贡献。
In recent years, with the acceleration of China’s economic construction and the transformation of social construction into a period of transition, job-related crimes at all levels and in all fields have become increasingly prominent.
