随着数字技术的迅速发展,图书馆和版权人由相互依赖走向对立,版权纠纷不断,数字版权保护面临着巨大的挑战。本文认为应该在坚持利益平衡原则,考虑我国现阶段的基本国情,寻求利益天平向社会公共利益一方适度倾斜的基础上对公益性数字图书馆合理使用的范围作出界定,以期建立一个以发展为导向的符合我国国情的公益性数字图书馆合理使用制度。
With the rapid development of digital technology, libraries and copyright holders have turned from interdependence to opposites and copyright disputes have continued. Digital copyright protection faces great challenges. This paper believes that we should define the scope of fair use of digital libraries on the basis of adhering to the principle of balance of interests, considering the basic national conditions at the present stage of our country and seeking a moderation of balance of interests to one side of social public interest so as to establish a development oriented In line with China’s national public good digital library fair use system.
