人格尊严权是民事主体的基本权利。单位内一些因内部矛盾产生闹访、缠诉等问题人员,依照宪法等法律规定,仍然具有人格尊严权。单位在化解问题员工矛盾过程中,必须遵照法律规定保护其人格尊严权,通过尊重其人格尊严权,体现化解矛盾的诚意,促进矛盾化解。对问题员工的司法保护,实质上就是从人权入宪高度,理解人格尊严权是人格权中的核心权利。
Dignity of human rights is the basic rights of civil subject. Some personnel within the unit who have been making troublemaking or appealing to trouble due to internal conflicts still have the right to human dignity in accordance with the provisions of the Constitution and other laws and regulations. During the process of resolving employee conflicts, the unit must protect its personality and dignity in accordance with the law and respects the contradiction by upholding its right to personality and dignity, reflecting its sincerity in resolving contradictions. Judicial protection of employees on the issue is essentially from the perspective of human rights into the Constitution, understanding the dignity of human rights is the core rights of personality rights.
