在高等学校教育教学活动中,由于高校与学生的法律关系模糊不清,权利和义务不界定,致使双方经常会因权利和义务之争发生法律冲突,严重影响了和谐校园的建设。因此,厘清高校与学生的法律关系,界定高校与学生在不同法律关系中的权利和义务,对加快高校的法制化进程,实现依法治校,构建和谐文明的法治校园,有着重要意义。
In the education and teaching activities of colleges and universities, due to the unclear legal relationship between universities and students and the lack of definition of rights and obligations, the two sides often encounter legal conflicts due to the dispute of rights and obligations, which seriously affects the construction of a harmonious campus. Therefore, to clarify the legal relationship between universities and students and to define the rights and obligations between universities and students in different legal relations is of great significance to speeding up the process of legalization of colleges and universities, implementing the rule of law according to law and building a harmonious and civilized school of law.
