城市的临时建设和临时建设用地对城市规划的实施具有重要影响,同时如何严格依法规范城市临时建设和临时建设用地的规划管理,也是城市政府主管部门的重要职责,为此,我局依据《中华人民共和国城市规划法》《上海市城市规划条例》,并结合本市城市建设发展的实际情况,制定了本规定,明确任何单位和个人需要在城市规划区内临时使用土地或进行临时建设都应当征得城市规划行政管理主管部门同意,不得影响城市规划的实施。同时考虑到临时建设和临时建设用地的情况复杂性和具体性,规定各区、县城市规划管理部门负责所在区域范围内的临时建设和临时建设用地规划管理。但在重要地区、重要道路范围内的临时建设和临时建设用地应当征得市规划局的同意,从管理源头上明确职责,与此同时,该规定还对临时建设、临时建设用地的含义及规划管理规定,临时建设改变用途,临时建设用地改变用途及临时建设和临时建设用地的有效期限,无条件拆除、恢复,报建要求,处罚等均作了相应规定,以确保城市规划实施的健康有序。
