恶法亦法与恶法非法的争论从古至今都未停止过。代表不同的阶级利益,对公平正义的不同理解等因素都是其支持某一观点的依据。一部法律的好坏并不影响其是法的事实,只是说它能不能更好的处理好公平正义的问题。对于恶法到底是不是法的问题,个人认为可以从法的概念中看出。法是指国家按照统治阶级的利益和意志制定或者认可、并由国家强制力保证其实施的行为规范的总和。从其概念中可以看出,法不是由它的好坏来决定。法是由人类制定,本身就不能避免人思维局限性所带来的缺陷。
The controversy that the law of evil has been violated and the law of evil has not stopped ever since. The factors that represent different class interests and different understandings of fairness and justice are the bases on which they support a certain point of view. The quality of a law does not affect the fact that it is a law, only that it can better handle the issue of fairness and justice. For the evil law in the end is not a matter of law, individuals think it can be seen from the concept of law. Law refers to the state in accordance with the interests and will of the ruling class to develop or recognize, and by the national coercive force to ensure that the implementation of its code of conduct. It can be seen from its concept that law is not determined by its quality. Law is made by human beings, itself can not avoid the limitations of human thinking caused by defects.
