第一章总则第一条为了保护商事活动中当事人的合法权益,规范商事行为,保障商事法律正确适用,维护社会主义市场经济秩序,制定本法。第二条本法规定商人和商行为的一般规则。第三条商人的营业自由受法律保护,非经法律、行政法规规定不得限制。第四条商事交易的便捷受法律保护。第五条商事交易的安全受法律保护。法律、行政法规对商事行为的形式作出强制性规定的,商事活动当事人应严格遵守。
Chapter I General Provisions Article 1 This Law is enacted in order to protect the lawful rights and interests of the parties involved in commercial activities, standardize commercial practices, safeguard the proper application of commercial laws, and safeguard the order of the socialist market economy. Article 2 The general rules of the law on merchants and traders. Article 3 The commercial freedom of businessmen shall be protected by law and shall not be restricted by laws and administrative regulations. Article 4 The convenience of business transactions is protected by law. Article 5 The security of commercial transactions shall be protected by law. Where laws and administrative regulations make mandatory provisions on the form of commercial acts, the parties to commercial activities shall strictly observe them.
