运用脚本理论工具对“上海张军弃婴案”中的辩护律师和被告人之间的一段直接询问进行认知语言学分析,以揭示辩护律师怎样通过询问,激活和重构储存于庭审法官脑海中的脚本图式,从而改变法官对被告人犯罪行为的认知态度,并最终赢得有利于被告人的判决。律师的庭审话语充满着各种方式的认知操控,而认知语言学的各种分析手段(包括脚本理论)可以用来对庭审话语进行更加深入细致的分析。
Using scripting theory tools to conduct a cognitive linguistic analysis of a direct questioning between defense lawyers and defendants in Shanghai Zhang Jun Abandonment Case to reveal how defense lawyers can save money in court by asking, Judge’s mind in the script schema, thereby changing the judge’s attitude toward the accused criminal behavior, and eventually won the favor in favor of the accused. The trial discourse of lawyers is full of cognitive manipulation in various ways. Various analytical methods of cognitive linguistics (including scripting theory) can be used to conduct more detailed analysis of court discourse.
