在我国,民营企业发展的法律环境,实质上是政府与民营企业的关系问题。政府应致力于建立和完善以促进和保护为价值取向的民营企业法律制度,并保证这些制度的落实。从法律上确认民营经济以来,民营企业的法律环境不容乐观,由于身份不同、相关政策不落实、政府职能不适应等问题,民营企业并未获得严格的产权保护和真正平等竞争的市场。本文认为,民营企业发展的法律环境的改善,应该把重点放在改变区别对待、消除中央和地方政府政策的矛盾、提高政府服务质量、完善中小企业融资体系、改进中小企业的税负政策。
In our country, the legal environment for the development of private enterprises is essentially the relationship between the government and private-owned enterprises. The government should devote itself to establishing and perfecting the legal system of private enterprises that promote and protect the value orientation and guarantee the implementation of these systems. Since the legal recognition of the private economy, the legal environment for private enterprises is not optimistic. Due to their different identities, the relevant policies are not implemented and the functions of government are not suitable, private enterprises have not obtained the strict market of property rights protection and truly equal competition. This paper argues that the improvement of the legal environment for the development of private enterprises should focus on changing the treatment of discrimination, eliminating the contradictions between the central and local government policies, improving the service quality of the government, improving the financing system of SMEs and improving the tax burden policy of SMEs.
