在权力的实际运行中,执掌权力的主体具有自由裁量的空间,必须将执掌权力的主体置于有效制约与监督其权力的权力运行体系之中,才能保证他们用公共权力来为公共利益服务。笔者认为,只有通过加强决策科学化、民主化、法制化的制度保障建设、加强依法行政的制度化、加强权力制约制度建设、加强监督制度建设、加强惩戒制度建设等把公共权力关进制度的笼子里,形成权力运行的系统分析,才能充分发挥制度笼子的功效。
In the actual operation of power, the main body in charge of power has the discretionary space, and the main body in power must be placed in the power running system that effectively restricts and supervises its power, so as to ensure that they use public power to serve the public interest.
