典权是一项具有中国特色的物权制度,目前世界各国仅有韩国与中国台湾地区明文规定加以保护。典权“保留论”与“废除论”的争论由来已久,立法机关在这一问题上也是举棋不定全国人大常委会公布《物权法》草案前两稿均设典权之制,而最近公布的《物权法》草案第三稿则删除了有关典权制度的规定。从典权的物权性质谈谈典权在公示中存在的一些问题,如果典权公示问题无法解决,则典权制度在实践中将会遇到无法逾越的障碍。
Dianquan is a real right system with Chinese characteristics. At present, only countries in South Korea and Taiwan in China expressly provide protection. The controversy over “reservation theory” and “repeal theory” of the potentate is a long standing issue. The legislature is also indecisive on this issue. The NPC Standing Committee promulgates the system of authorizing the first two drafts of the “Property Law” and the recently announced " The third draft of the Property Law deleted the provisions on the system of dianquan. From the nature of pawn right to talk about some of the problems that pawn appears in the public notice, if pawn question can not be solved, pawn right system will encounter insurmountable obstacles in practice.
