文章从编辑和出版实务的角度出发,结合国家相关法律法规和行政规章,论述了图书出版过程中涉及的版权问题。图书出版工作涉及的版权问题主要包括3大板块:正文、封面和插图、版式设计。在正文中,笔者在进行了一般性说明之后,例解了自己处理过的几种特殊类型的作品所涉及的版权问题。这些作品类型是:汇编作品、合作作品、翻译作品、委托作品、数字化作品。关于封面和插图的版权问题,作者结合相关诉讼案例指出,使用他人的图片和设计资料应获得授权并支付合理费用,编辑应注意事先防范,确保自己编辑的图书没有未经许可使用他人的图片和设计资料。关于版式设计,笔者认为,不同内容和种类的图书,其版式设计风格迥然不同;相对于一般学术专著,畅销类图书的版式设计更应受到保护;版式设计也贯穿了设计人的创意和思路,编辑在实务工作中可以参考其他社版的图书版式,但应避免直接套用。
From the perspective of editing and publishing practice, the article discusses the copyright issues involved in the process of publishing books, combining the relevant state laws, regulations and administrative regulations. The copyright issues involved in the book publishing work include three major sections: the text, cover and illustrations, layout design. In the main text, after a general explanation, I have explained the copyright issues involved in several special types of works that I have dealt with. The types of works are: compilation works, cooperative works, translation works, commissioned works, digitized works. Regarding the copyright of the cover and illustrations, the author, in connection with the relevant litigation cases, pointed out that the use of other people’s pictures and design materials should be authorized and paid a reasonable fee. Editors should take precautions to ensure that their own editorial books have no unauthorized use of others’ pictures and Design Resources. On the layout design, the author believes that different content and types of books, layout design style is very different; relative to the general academic monographs, best-selling book layout design should be protected; layout design also runs through the designer’s ideas and ideas, Editors in the practice can refer to other editions of the book layout, but should be avoided directly applied.
