一、侦察破案是公安机关履行职能的基本手段公安机关既是侦察机关,又是国家治安行政管理部门,担负着“打击敌人,惩治犯罪,保卫人民,服务四化”的重大职责,侦察破案与治安管理是公安机关履行职能,维护社会稳定的两大基本手段,减少发案,提高破案率有赖于治安管理和基层基础建设,而维护社会治安行政秩序,首要环节是预防、打击犯罪分子对治安行政秩序的破坏,基层基础建设要服务现实讲实效,着眼长远添后劲,根本目的在于预防、控制、发现与打击犯罪分子的破坏活动。各类犯罪分子的破坏是通过“案件”的形式来实施的,无非是“政治案件”、“刑事案件”、“治安案件”。在通常情况下,以一个地区而言,刑事案件是大量的,而且危害是最严重的,刑事案件基本上也可说是严重的治安案件,而且往往政刑交织,许多政治犯罪以刑事犯罪形式和手段来实施破坏。因此,刑事侦察工作在公安机关处于特别重要的位置,侦察破案工作水平是党委、政府和社会各界衡量公安工作效能的重要标准。如果一个地方多数恶性大案破不了,公安工作就会陷入被动。因此,建立与完善适应斗争形势需要的刑侦体制与破案机制,是事关全局的问题。
