我国作为传统农业大国对农业生产一直非常重视,但在立法层面上,法律、法规在农业保驾护航过程中所发挥的作用并不明显,依法治农的原则在我国并未确立,部分农业发展所需的法律还存在缺位的现象,农业立法体系仍不完善,这些都一定程度影响了农业的稳定健康发展、农民合法利益的保障和农村社会的安定和谐,而美国新通过的2014年农业法案在农业发展保障方面展示出了其农业立法的成功经验,值得我们去研究和借鉴。
