农村征地拆迁纠纷解决是我国城市化加速发展时期必然面临的命题。农村征地拆迁关乎各方重大利益,且我国在此方面的法治建构尚不完善,征迁各方“偏离法治的利益博弈”极易产生矛盾乃至于引发流血冲突。农村征地拆迁问题不仅是重大的民生问题,亦是重大的政治问题。城市化进程与空间拓展的必然对应性表明,倘若无法建立行之有效的农村征迁矛盾化解机制,农村征迁矛盾势必成为我国现代化建设过程中的一股重要阻滞力量。因而,深入探究农村征迁纠纷化解机制失效之因由并寻求理性破解之道实乃当务之急。
Dispute settlement in rural land acquisition and demolition is the inevitable challenge to the urbanization in our country. The land requisition and demolition in rural areas are of great interest to all parties, and the construction of the rule of law in our country is still not perfect. The “game of interests that deviates from the rule of law” can easily lead to contradictions and lead to bloodshed. Land requisition and demolition in rural areas is not only a major livelihood issue, but also a major political issue. The inevitable correspondence between the process of urbanization and the expansion of the space shows that the contradiction between rural acquisitions and acquisitions will inevitably become an important deterrent force in the process of our country’s modernization if we can not establish a well-established system for resolving contradictions in rural areas. Therefore, it is urgent task to probe deeply into the causes of failure to resolve the system of settling disputes in rural areas and seek rational solutions.
