瑞典法律援助惠及人群普遍,覆盖领域广泛,公民享有较好的平等司法权。但是,政府负担太重,管理组织复杂和费用昂贵。基于此,近期瑞典政府对法律服务政策进行了改革,缩小了法律援助的范围,申请援助前强制要求法律咨询,引进“合作式对话”解决大部分的家庭纠纷。这次改革转换了法律援助与法律费用保险之间的关系,影响了它们对平等司法的作用。我国法律费用救助制度处在发展和完善中,因此有必要借鉴瑞典法律服务政策的改革经验,以促进我国公民享有平等司法权。
Swedish legal aid benefits the general population, covers a wide range of areas and citizens enjoy better equal access to justice. However, the government is overburdened, the management organization is complex and expensive. Based on this, the Swedish government recently reformed the legal service policy, narrowed the scope of legal aid, forced legal advice before applying for aid, and introduced “cooperative dialogue” to resolve most of the family disputes. The reform has transformed the relationship between legal aid and legal cost insurance, affecting their role in equitable justice. China’s legal aid system is in the development and improvement, it is necessary to learn from Sweden’s legal services reform experience to promote our citizens to enjoy equal judicial power.
