离职竞业限制是雇主在雇员离职后与雇员在劳动合同中进行约定以保护企业商业秘密的一种法律措施。劳动合同法及司法解释对竞业限制进行了一些规制,但在竞业限制的主体、范围、期限、经济补偿和违约责任等方面还可以进一步完善,更好地发挥竞业限制的功效。
