【裁判要旨】建筑物区分所有权包含专有权、共有权和管理权,因此,对于相邻车位之间的公共部分,相邻车位的业主除了享有对车位专有部分的所有权之外,还享有对该公共部分平等的合理使用的权利。开发商擅自将该公共部分出售给一方业主,显然剥夺了另一方对公共部分合理使用的权利。开发商和一方业主的行为构成共同侵权,依法应当共同排除妨碍。
