民事检察原则是贯穿于整个民事检察制度并起着主导作用的根本规则。由于我国民事检察制度在民事诉讼中运行,同时又是我国检察制度的重要组成部分,因此民事检察原则既应彰显检察制度法律监督的本质属性也应当遵循民事诉讼规律。检察机关进行民事检察的监督目的、监督地位、监督范围、监督效力、监督方式以及监督属性决定了民事检察原则包括:维护司法公正和司法权威、居中监督、合法性监督、程序性监督、多元化监督和谦抑监督原则。
The principle of civil procuratorial work is the fundamental rule that runs through the entire system of procuratorial work and plays a leading role. As China’s civil prosecution system operates in civil lawsuits and is also an important part of procuratorial system in our country, the principle of civil procuratorial work should not only demonstrate the essential attributes of legal supervision of procuratorial system, but also should follow the law of civil procedure. The purpose of procuratorial organs’ supervision over civil procuratorial work, the status of supervision, the scope of supervision, the effectiveness of supervision, the mode of supervision and the attributes of supervision determine the principles of civil procuratorial work. They include: safeguarding judicial fairness and judicial authority, centering supervision, legal supervision, procedural supervision and diversification Supervise and discipline the principle of supervision.
