政府信息公开的核心内容是政府信息公开范围,公开范围的限定直接决定了政府的透明度和公民的知情权。自《政府信息公开条例》公布实施后,公民在申请信息公开和法院在审理政府信息公开案件中都遇到了阻碍,问题的根源往往是政府信息公开的范围的不明确和模糊性。本文通过对政府信息公开范围进行研究,比较各国立法,同时提出了相应的完善措施和建议。
The core content of government information disclosure is the scope of government information disclosure, the limited scope of the open government directly determines the transparency of the government and the citizens’ right to information. Since the promulgation and implementation of the “Regulations on the Disclosure of Government Information,” citizens have encountered obstacles in the open application of information and the court’s handling of government information open cases. The root of the problem is often the ambiguity and ambiguity of the scope of government information disclosure. This paper studies the scope of the government information disclosure, compares the national legislation, and puts forward the corresponding improvement measures and suggestions.
