各国政府在总结GATT的经验与不足之后 ,为适应贸易自由化趋势 ,成立了以世贸规则为核心的世界贸易组织。在政府的一致努力下 ,世贸规则获得了法律上的拘束力 ,一旦承诺入世 ,政府就必须严格执行该规则 ,我国政府也不例外。这必然会对依法行政产生冲击和影响 ,尤其在职权法定和行政比例方面。此外 ,政府依法执行世贸规则应注意协调世贸规则与原则之间的关系、国内法与世贸规则之间的关系、保护我国国内产业与严格执行世贸规则之间的关系。
After summing up the experiences and deficiencies of GATT, governments of all countries have established the WTO that focuses on the WTO rules in order to meet the trend of trade liberalization. With the concerted efforts of the government, the WTO rules have been legally binding. Once they have promised to enter the WTO, the government must strictly implement the rules and our government is no exception. This inevitably will have an impact and influence on the administration by law, especially regarding the statutory and administrative ratios of the functions and powers. In addition, the government’s implementation of the WTO rules according to law should pay attention to coordinating the relations between the WTO rules and principles, the relations between domestic laws and the WTO rules, and protecting the relations between our domestic industries and the strict implementation of the WTO rules.
