我国现行农地征收中的补偿机制仅体现了对农民的利益让与,并未反映农民在土地物权变动中的权利配置。在土地征收过程中,农民因其权利的缺位出现了利益保障的困境,阻碍了经济的良性运行。今后当以承包经营权的物权化为起点,以农民的参与机制为基础,以便捷的救济渠道为依托,以就业安置与社会保障为后盾,建构农户在征地过程中的权利体系。赐农民以利益莫如赋农民以权利,以权利的主张制衡权力的滥用,以权利的行使达到利益的均衡,应当是解决现实中农地征收问题的关键。
The current compensation system for farmland expropriation in China only reflects the interests of peasants and does not reflect the peasants’ rights allocation in the changes of land ownership. During the process of land expropriation, peasants appeared the predicament of interests protection due to the absence of their rights, hindering the healthy operation of economy. In the future, when taking the property right of contracting management as the starting point, based on the participation mechanism of peasants, relying on the convenient relief channels and with the backing of employment and social security as backing, the rights system of the peasants in the process of land acquisition will be constructed. Give the peasantry with the interest of the peasantry as the right, with the idea of the right to check the abuse of power, the exercise of the right to achieve a balanced interests, should be the key to solve the problem of the actual acquisition of agricultural land.
