对刑事诉讼中的羁押工作实行监督,是法律赋予检察机关的一项重要的监督职权。当前检察监督羁押工作中存在的主要问题包括监督、配合关系的不协调;检察监督体系架构不明晰;检察监督的渠道少,手段单一。建议从完善立法和司法解释、整合检察内部职能优势、健全和完善外部监督制约机制等方面加强对羁押工作的检察监督。
The supervision of detention in criminal proceedings is an important supervisory authority that the law gives the procuratorial organs. The main problems in the current procuratorial supervision and detention include the incompatibility between supervision and cooperation; the unclear system structure of procuratorial supervision; the lack of channels for procuratorial supervision and the single means. It is suggested to strengthen procuratorial supervision of detention in terms of improving legislation and judicial interpretation, integrating the advantages of procuratorial internal functions, and improving and perfecting the external supervision and restriction mechanism.
