2005年12月2日,国务院颁布了《关于发布实施促进产业结构调整暂行规定的决定》;同日,经国务院批准,国家发展和改革委员会配套发布了《产业结构调整指导目录》。此前国务院有关部门发布实施了国家重点鼓励、限制和淘汰的三类产业目录,但许多内容已不适应当前产业结构优化升级和宏观调控的需要,也缺乏一个系统性、纲领性、综合性的产业结构调整指导文件。出台并实施《促进产业结构调整暂行规定》和《产业结构调整指导目录》,是实现“十一五”规划目标的一项重要举措,也对全面落实科学发展观,加强和改善宏观调控,进一步转变经济增长方式,推进产业结构调整和优化升级,保持国民经济平稳较快发展具有重要意义。《促进产业结构调整暂行规定》明确了当前及今后一段时期产业结构调整的目标、原则、方向和重点,以及《产业结构调整指导目录》中鼓励、限制和淘汰三类目录的分类原则和配套政策措施。《产业结构调整指导目录》是《促进产业结构调整暂行规定》的配套文件,涉及农业、水利、煤炭、电力、交通、信息产业、钢铁、有色金属、石油化工、建材、机械、轻纺、服务业、环境和生态保护、资源节约及综合利用等20多个行业,其中鼓励类539条,限制类190条,淘汰类399条。《促进产业结构调整暂行规定》对国家鼓励类、限制类、淘汰类产业目录提出了明确要求。对鼓励类投资项目,按照国家有关投资管理规定进行审批、核准或备案,各金融机构应按照信贷原则提供信贷支持,国家给予有关税收优惠政策支持。对属于限制类的新建项目,禁止投资,投资管理部门不予审批、核准或备案,各金融机构不得发放贷款,土地管理、城市规划和建设、环境保护、质检、消防、海关、工商等部门不得办理有关手续;对属于限制类的现有生产能力,允许企业在一定期限内采取措施改造升级,金融机构按信贷原则继续给予支持。对淘汰类项目,禁止投资,各金融机构应停止各种形式的授信支持,并采取措施收回已发放的贷款,各地区、各部门和有关企业要采取有力措施,按规定限期淘汰,在淘汰期限内国家价格主管部门可提高供电价格,对国家明令淘汰的生产工艺技术、装备和产品,一律不得进口、转移、生产、销售、使用和采用;对不按期淘汰生产工艺技术、装备和产品的企业,地方各级人民政府及有关部门要依据国家有关法律法规责令其停产或予以关闭。

The Interim Provisions on Promoting Industrial Structure Adjustment clearly defined the objectives, principles, directions and priorities of the industrial restructuring at present and in the forthcoming period and the classification principles and supporting policies for encouraging, limiting and eliminating the three types of catalogs in the Guiding Catalog of Industrial Structure Adjustment Measures. The Guidance Catalog for the Adjustment of Industrial Structure is the supporting document for the Interim Provisions on Promoting the Readjustment of Industrial Structure, covering agriculture, water conservancy, coal, electricity, transportation, information industry, steel, nonferrous metal, petrochemical industry, building materials, machinery, textile and light industry, service Industry, environmental and ecological protection, resource conservation and comprehensive utilization of more than 20 industries, of which 539 encouraged, restricted 190, out of 399. The Provisional Regulations on Promoting the Adjustment of Industrial Structure set out clearly the requirements for the catalogs of encouraged, restricted and obsolete industries in the country.
