我国单一制的国家结构形式以及特别行政区地方行政区域的法律地位,决定了特别行政区的高度自治权属于中央授予的地方自治权,这是特别行政区高度自治权的一般性质。而我国“一国两制”的基本方针政策,又使得特区高度自治权具有了一些不同于一般地方自治权的特殊性质,主要体现为权力范围的广泛性及自治程度的高度性。特区高度自治权在实践中的正确贯彻落实,需要正确处理特区高度自治权的一般性质与特殊性质。
