民事案件立案活动是指人民法院接受当事人民事起诉后,决定予以受理的行为,是当事人得以顺利进行后续诉讼活动的前提和基础。修改后民诉法只是泛泛规定了检察机关有权对民事立案活动进行监督,而对于监督范围、监督程序、监督效力等问题均未作出具体规定。笔者认为,应当从立案监督的主体和范围、启动程序、立案监督权的行使原则、行使方式及监督效果的保障机制等方
The act of filing a case in civil case means that the people’s court, after accepting the civil prosecution of the party, decides to accept the case, which is the premise and basis for the successful conduct of the litigation.
