本文将煤矿安全监察作为广义的行政行为而不是当作狭义的安全检查或行政处罚进行论述,提出了创新煤矿安全监察的理论和方法。全文从对煤矿安全监察职责的理解入手,重点论述了抓班子带队伍的创新方法、国家监察的创新理念;具体分析了煤矿安全监察执法过程需要创新的原因并指出了努力的方向;分别论述了自由裁量权使用的创新标准、走群众路线的创新办法、“执法”外监察环境的创新培育、煤矿安全文化建设创新的重要性。
In this paper, coal mine safety supervision as a generalized administrative act rather than as a narrow sense of safety inspection or administrative penalties are discussed, put forward innovative coal mine safety supervision theory and methods. Based on the understanding of the responsibility of coal mine safety supervision, this paper mainly discusses the innovative methods of team leader and team innovation and the innovative concept of national supervision. It analyzes the reasons that need to be innovated in coal mine safety supervision and enforcement process and points out the direction of their efforts. Innovative standards for the use of discretionary power, innovative ways of taking the mass line, innovation and cultivation of the environment under the supervision of law enforcement, and the importance of innovation in building a coal mine safety culture.
