本文运用实证的研究方法,以房屋的善意取得为视角,从而对我国整个不动产善意取得制度进行了考察。无论是学理上还是从实证研究,都表明我国《物权法》106条规定的不动产善意取得制度存在很大问题。为此,笔者在学理基础之上结合实证的数据进行了深入的探讨。并建议,目前可以通过司法解释的方式给予《物权法》第106条予以限缩解释,解释为主要适用于动产,不动产交易的信赖保护可以通过解释《物权法》第16条的规定来实现。
This article uses the empirical research method, takes the goodwill acquisition of the house as the visual angle, thus has carried on the inspection to our country entire real estate bona fide acquisition system. Neither academic nor empirical research shows that there is a big problem with the system of bona fide acquisition of real property stipulated in Article 106 of the Real Right Law of our country. For this reason, the author has carried on the thorough discussion with the empirical data on the basis of the theory. It is suggested that Article 106 of the Real Right Law can be narrowed and interpreted as judicial interpretation at the moment, which is interpreted as being mainly applicable to movable property. The trust protection of real estate transactions can be realized through the interpretation of Article 16 of the Real Right Act.
