法官对法律的把握和解读有具象抽象之分,前者表现为对具体案件的裁判,后者集中在司法解释的制定。两者相较,抽象作业无疑更具根本性。《物权法司法解释一》是聚焦《物权法》中重要基础性问题的首部司法解释,准确把握相关规定之意旨,不仅事关其正确适用,也对更进一步研究物权法诸多重大问题具有积极意义。
Judges grasp and interpret the law as a concrete abstract, the former manifested as a specific case of the referee, the latter focused on the formulation of judicial interpretation. In contrast, abstract work is undoubtedly more fundamental. “Judicial Interpretation of Property Law” focuses on the first judicial interpretation of important basic issues in “Property Law” and accurately grasps the meaning of the relevant provisions. It not only concerns its correct application, but also has positive significance for further studying many major issues of Real Right Law.
