茅盾文学奖由于其制度设计的缺陷,在奖项评选上缺乏独立性,削弱了其权威性。为通过制度改造的方式赋予其独立性,本文从我国法人分类模式出发,在社团法人——财团法人的分类模式之下,通过建立茅盾文学奖基金会而实现制度改造的目的。无疑地,基金会为财团法人,通过将财团法人的机构设置运用于茅盾文学奖基金会,可以建立起基金会的决策、监督机构,完善基金会的机构设置。
Mao Dun Literature Award because of its system design flaw, the lack of independence in the selection of awards, undermining its authority. In order to give it independence through institutional transformation, this article starts from the classification model of legal persons in our country and realizes the goal of institutional reform through the establishment of the Mao Dun Literature Prize Foundation under the classification model of corporation corporation - incorporated corporation. Undoubtedly, the Foundation, a consortium of legal persons, can set up the foundation’s decision-making, supervise the institution and improve the institutional setting of the foundation by applying the establishment of the consortium to the Mao Dun Literature Prize Foundation.
