客观性证据的重要性越来越受到重视,正逐步成为公诉证据审查的基本立场。以客观性证据为基础构建的客观性证据审查模式在摆脱以口供为中心审查模式困境;防止冤假错案的出现;落实疑罪从无基本原则三个方面有着重要意义。在立法和司法上对于客观性证据的重视程度也越来越高,所以,应该将客观性证据审查模式作为公诉的基本立场。
The importance of objectivity evidence is getting more and more attention and it is gradually becoming the basic position of the prosecution evidence review. The objective evidence review mode constructed on the basis of objectivity evidence is of great significance in getting rid of the dilemma of censorship based on confession statements, preventing the emergence of unjustly wrongdoings and carrying out the crime of doubt from the three aspects of no basic principles. In legislation and judicature, the degree of importance attached to the evidence of objectivity is also getting higher and higher. Therefore, the mode of objectivity evidence examination should be taken as the basic position of public prosecution.
