比例原则对防止国家权力的滥用和保护公民个人权利具有非常重要的意义。我国刑事诉讼法中侦查程序有多处体现了比例原则的要求,但由于规定相对模糊,需要进行立法完善。
The principle of proportionality is very important for preventing the abuse of state power and protecting the individual rights of citizens. There are many requirements of the principle of proportionality in the procedure of criminal procedure law in our country, but because of the relative obscureness, the legislation needs to be perfected.
