邓伟志认为,道德与法律在治理国家中的作用是互相补充的。法是具有强制性的,德是靠褒贬来感化的,是用舆论来引导的。提倡德治应当明确一点:法治第一,德治第二。尤其是治国,而不是治哪一个具体的小单位,更不是专指个人修养,更应当坚持法治第一。在治国的问题上,不能搞二元论,不能搞平行论。鲜明地提出“法治第一,德治第二”,不仅使得“德治”论更丰满,而且会推动更多的人接受“德治”论。承认德治第二,决不意味着可以放松德治。
