我国正积极构建碳排放权交易制度,利用市场机制减排温室气体、推动低碳循环经济发展、实现绿色发展目标。碳排放权交易是一种特殊的市场机制,从其建立、运行到监管都始终贯穿着各种政府行为。根据现代市场经济法的要求,碳排放权交易中的管理性经济关系立足于并服务于基础性经济关系。在构建碳排放权交易监管法律制度时,现代市场经济法制应当科学回应政府与市场的互动关系,将市场决定与政府有为两大因素有机结合起来,从而推动我国绿色低碳循环经济发展。
China is actively establishing a carbon trading system, using market mechanisms to reduce greenhouse gas emissions, promote the development of low-carbon cycle economy and achieve the goal of green development. Carbon emissions trading is a special market mechanism, from its establishment, operation to regulation are always run through a variety of government activities. According to the requirements of the modern market economy law, the managerial economic relations in carbon emissions trading are based on and serve the basic economic relations. In constructing the legal system of carbon emissions trading supervision, modern market economy law should scientifically respond to the interactive relationship between government and market, organically combine the market decision with the government, and promote the development of green low-carbon recycling economy in our country.
