一、主管错误。人民法院对该由其主管的案件裁定不予受理,或者对不该由其主管的案件却受理裁判的,应予抗诉。 二、管辖错误。一是抢管辖权,违反地域管辖、专属管辖、共同管辖、协议管辖的规定,无管辖权所作的裁判;二是违反管辖的规定,将自己管辖的案件裁定推给其他法院的。
