制宪权是人民的应然性权力 ,也是人民的实然性权力。人民并不能直接参与制宪的全过程 ,而是要依赖其代表间接实现制宪目的。制宪有一系列程序 ,人民直接参与的主要是“决定制宪”和“选举产生制宪会议” ,有的国家还可以参与对宪法草案的讨论甚至表决。制宪中的主要工作———提出宪法动议、起草及详尽地讨论宪法草案 ,是由少数精英们完成的 ,许多国家宪法的通过也是由精英们表决的。但精英们并不仅仅是在表达自己的主观意志 ,他们在制宪中要受到各种因素的影响和制约。
Constitutional power is the people’s due power, but also the people’s real power. People can not directly participate in the constitutional process, but rely on their representatives to achieve the goal of constitutional development indirectly. Constitution has a series of procedures. The main direct participation of the people is “deciding to draft the constitution” and “voting for the establishment of a constitutional assembly.” Some countries can also participate in discussions or even vote on the draft constitution. The main work of the constitution-raising the constitutional motion, drafting and elaborating on the draft constitution was done by a handful of elites, and many national constitutions were voted on by elites. But the elites are not merely expressing their own subjective will. They are subject to various factors in the constitution-making process.
