随着《物权法》的颁布和即将实施,中国物业管理的发展正处于全面变革的关键时期,物业管理企业与业主的关系必将面临彻底的调整,法律赋予和保障下的业主的财产权利和社区自治权利将与传统的落后的物业管理模式产生新的冲突;与此同时,曾经为中国社会变革和社区建设作出过巨大贡献的物业管理企业,如何适应和主动调整新的形势下企业的生存业态和盈利模式,在构建和谐社会、推动物业管理行业以及企业自身的良性发展持续发挥积极作用,将是摆在物业管理企业面前的最关键问题。因此,全面学习和领会《物权法》中与物业及物业管理相关的精神和要旨,并从理论和实践方面研究探讨物业管理的战略调整,具有非常紧迫、现实和重要的意义。为此,由现代物业杂志社、中国法学会消费者权益保护法研究会与昆明市物业管理协会联合主办的“现代物业发展论坛·物权法研讨会”,于2007年5月21日—22日在美丽的春城——昆明隆重举行。来自全国各地的物业管理企业、房地产企业物业管理部门、国有企事业单位后勤部门、大专院校物业管理教学及科研部门相关人员、业主委员会委员(筹备组牵头人)等近百名代表共聚一堂,共同学习和探讨《物权法》中与物业及物业管理相关的精神、要旨及问题。与会代表围绕物权法与物业管理的相关条款展开了热烈的讨论,并对相关物管实务的法律构架、物业管理活动过程中的技巧及案例进行了交流。中国法学会消费者权益保护法研究会副会长、《物权法》直接起草人之一的河山教授,东南大学物业管理研究所所长黄安永教授则作了专题主讲;与会代表反响强烈,并就“物权法施行后物业管理企业将如何调整”进行了专题讨论,专题讨论会由现代物业杂志社社长、总编辑宋有兴,现代物业杂志社法律顾问、现代物业杂志“举案说法”法制专栏主持人孙可律师分时段主持。现将部分成果摘录如下。
